When we represent our Rochester, NY clients before the IRS our first step is to make sure the taxpayer is currently in Tax Compliance. We start here because it is the most critical part of tax resolution.
So, you might be asking WHAT is Tax Compliance, and why is it so important to your IRS case?
Tax Compliance means that the taxpayer:
- Has filed all tax returns for the last 6 years and
- Making current year tax payments via sufficient paycheck withholdings or if self-employed, submitting quarterly estimated tax payments.
Your next question might be WHY is compliance such a critical component to your IRS tax case? If you currently owe money to the IRS, they will not accept any offers on your back taxes debt. You must be in full compliance with the tax law and not growing (stacking) new tax debt.
Even though the IRS can seem intimidating, in our experience they are fully willing to work with taxpayers – either through payment plans (aka installment agreements) or offers in compromise. Unfortunately, they will not work with you if you are not filling you tax returns and/or continuing to run up new tax debts.
Furthermore, you need to maintain compliance once you have reached a deal with the IRS. If you fail to stay in compliance your arrangement / deal can and will be voided, and you’ll be forced to start over at square one.
